Moratorium on Water Service Shut Offs (Service Terminations) Set to Expire on September 30, 2021

On June 11, 2021, Governor Gavin Newsom issued Executive Order N-08-21, which addressed the expiration of various executive orders issued during the COVID-19 pandemic.  Of the several executive orders scheduled to expire, the Governor ordered that Executive Order N-42-20 shall remain in place until September 30, 2021, upon which time it shall expire. 

Executive Order N-42-20 restricted the ability of water systems to shut off residential service and service to qualifying small businesses (specifically, those in critical infrastructure sectors).  Pursuant to Executive Order N-42-20, the State Water Board established best practices and guidelines to be implemented during the COVID-19 emergency.  Since the issuance of Executive Order N-42-20, water systems were prohibited from shutting off water service for non-payment of a water bill.  You can read our firm alert on Executive Order N-42-20 here.
