Even Probationary Employees Have Rights: Understanding And Avoiding Risks When Dealing With Probationary Employees

With so much attention focused on “permanent” employee rights, it can be easy to lose sight of the protections that apply to all employees, including those still on probation.  This session will prepare Human Resources professionals to advise managers and supervisors about the limitations and procedural issues involved in probationary employee releases.  In addition to covering common employment rights that apply to all employees, the presenters will discuss constitutional protections and other rights that probationary employees often raise when challenging a termination.  They will also discuss best practices for handling probationary issues such as when probation can be extended, and whether and when to give a reason for termination.  The speakers will draw on their experience to highlight common trouble spots in probationary terminations, and share best practices for developing defensible policies and procedures for administering the probationary period.
