Melendez v. San Francisco Baseball Associates, currently pending before the California Supreme Court, raises unique issues regarding the intersection of the California Labor Code and Collective Bargaining Agreements (“CBAs”).  For example, when do Labor Code violations fall within a CBA’s arbitration provision?  When are Labor Code claims preempted by a CBA?   How has the seminal case of Penn Plaza been extended?  Our expert panel, including Dennis Moss (who recently argued Melendez before the California Supreme Court) and AALRR attorney Ron Novotny (who has extensive expertise in issues involving unions and unfair labor practices), will discuss these issues and the developing law in this area.
