AALRR Breakfast Briefing ~ The ADA’s New Role In Public Education

01.28.2014
Program: 8:30am - 10:30am
Location: Cerritos Library

Until the Ninth Circuit’s decision in K.M. v. Tustin Unified School District, 725 F.3d 1088 (9th Cir. 2013) school districts were presumed to be in compliance with their educational responsibilities to special education students with disabilities under the Americans with Disabilities Act (“ADA”) as long as they provided those students with a free and appropriate public education under the Individual with Disabilities Education Act (“IDEA”). According to the Ninth Circuit, that is no longer the law. Now school districts may be obligated to provide more/different aids, services, or accommodations under the ADA than would be required under the IDEA. In light of this drastic change, school districts need to understand what is required in order to meet their obligations to special education students under the ADA. This presentation will review the ADA, the regulations districts must comply with, and provide practical advice for what to do when faced with a request that may implicate the ADA.

We look forward to seeing you at this complimentary briefing and discussion.

Attendance available to district employees only.
