OCR and OSEP Issue Six Guidance Documents, Again Cautioning School Districts to Ensure Nondiscriminatory Practices in Discipline and Behavior Management for Students with Disabilities

On July 19, 2022 the U.S. Department of Education, Office for Civil Rights (OCR) and Office of Special Education Programs (OSEP) issued six guidance documents, all focused on behavior support and discipline of students with disabilities. The not so gentle message from OCR and OSEP is the renewed and ongoing expectation that due to the increased mental health related concerns for our nation’s students, caused in part by the COVID-19 pandemic, school districts must find ways to support behavior related needs without first resorting to suspension and/or expulsion.
