Caught in the Crossfire: Union Decertification Campaigns

Your public agency likely has a long and stable relationship with at least one labor association.  But imagine if that association becomes the subject of a decertification drive.  All of a sudden, a rival organization is talking to your employees in the parking lot, serving Public Records Act requests, seeking contact information for  employees, and collecting signatures for a decertification petition.  Then the decertification petition arrives.  Can you conduct a decertification election without violating your duty of strict neutrality?  Are you ready for the unfair practice charge that often follows the election, invariably filed by the losing party?  Did you improperly allow or deny access to the challenging union?  Was favoritism exhibited for the incumbent such that the election result should be overturned?  This session will cover all these topics and more, as we take attendees behind the scenes in one of the most challenging scenarios in labor relations.
