Overview

Randy Parent represents public and private clients for their facilities, construction, and property needs. Mr. Parent’s practice involves all aspects of construction law and public contracting law for a variety of matters involving construction contracts, business contracts, bidding and RFP procurement documents and processes, sole source procurement negotiations, claims defense and resolution, litigation, mediation, and arbitrations, board governance issues, facilities use, and non-profit entity establishment and governance.

Prior to joining AALRR, Mr. Parent spent 15 years as a Deputy City Attorney for the City and County of San Francisco. Further, Mr. Parent served as the chief contracts and lead construction attorney for the San Francisco Public Utilities Commission (SFPUC) for 9 years. SFPUC manages property from above Hetch Hetchy Reservoir and Dam at Yosemite down the valley to (and under) the bay, and up the Peninsula to San Francisco. He also provided legal counsel for the San Francisco International Airport, the Municipal Transportation Agency, the Public Works department, and the City Administrator.

Mr. Parent previously served as the Executive Director and CEO for the California Alumni Association at UC Berkeley for 6 years and built the award-winning music program at James Logan High School in Union City during his 6 years as the director of bands and fine arts department chair, and 6 years as the New Haven Unified School District’s Coordinator of the Arts and Athletics.

Representative Matters

Successful Prosecution of Fraud and False Claims:  Authored and negotiated San Francisco Unified School District’s design-build contract documents for $30 million energy services project for retrofits at 140 school sites with energy savings guaranteed to equal or exceed project costs.  Contract documents and contemporaneous documentation successfully protected District against developer claims for delay impact and extra work. Settled the case with developer agreement to pay District $43 million (primarily based on liquidated damages), even though developer had completed 90% of the work on the $30 million project.

Trial Court and Appellate Victory:  Lead counsel successfully defending the City and County of San Francisco in Doherty Truck Rental’s bid protest, writ of mandate proceeding and subsequent appeal.  Appellate court upheld trial court decision granting the City’s motion for summary judgment.

Favorable Mediation Settlement: Lead counsel prosecuting San Francisco Public Utility Commission’s claim against Kaiser Hospitals seeking $450,000 for damage to a major water pipeline.  Settled in mediation for Kaiser’s $375,000 payment to City.

Appellate Victory: Overturned a district court summary judgment decision against construction contractor S.J. Amoroso in an appeal before the U.S. 9th Circuit Court of Appeals in a breach of contract action against an insurer for wrongful denial of coverage on a construction defect claim (2009 U.S. App. LEXIS 9182). The 9th Circuit remanded Amoroso’s claim to the District Court. Prevailed on summary judgment before the U.S. District Court on the breach of contract claim (2009 U.S. Dist. LEXIS 116080).  Drafted all briefs for both cases.

Arbitration Victory: Prevailed on behalf of homeowner client in an arbitration against roofer whose $80,000 roof failed three years after being installed. The arbitrator awarded the homeowner $117,267.89 in damages, $38,109.27 for attorney’s fees, and $3,680.46 for costs for a total award of $159,057.62. 

Favorable Mediation Settlement: Lead counsel prosecuting City and County of San Francisco’s design defect case against architects on construction of the new Main Library at Civic Center. Achieved mediation settlement with joint-venture architects’ insurance paying their professional liability policy limits to City and architect taking responsibility to settle all outstanding contractor claims, many of which were significant.

Successful Prosecution and Settlement of False Claim Action: Member of City Attorney’s Office team that successfully prosecuted false-claim action against the general contractor (Tutor) that built the new San Francisco International Airport International Terminal, which resulted in a $195 million payment to San Francisco and the contractor’s agreement to abstain from bidding on San Francisco projects for five years.

Favorable Mediation Settlement: Lead counsel prosecuting City and County of San Francisco’s claims against contractor, subcontractors and architect for defective flooring in AIDS research facility at San Francisco General Hospital.  Recovered $200,000 – sufficient to replace all defective flooring.
