In a discussion entitled, “Handling HR Problems in the Union-Management Relationship Workshop: Blurred Lines — Social Media in the Workplace”, Tom Lenz and other faculty will explore the recent history of social media post regulations in the workplace as well as NLRB standards and arbitrator reasoning involving employee use of social media on- and off-duty. Also to be examined are recent discipline cases of alleged social media violations, involving Facebook posts by teachers and employees wearing “easily identified” company clothing at high visibility protests, and issues of evidence challenged in arbitration hearings.

With the recent avalanche of allegations of sexual harassment, sexual misconduct, and sexual assault making headlines, workplace harassment is getting more attention in the media. This increased attention raises issues of what will happen next, and how are employers, employees, unions,  legislatures, and enforcement agencies responding to the #MeToo movement.

Please join AALRR partner Jonathan Judge for a panel discussion on “Harassment in the #MeToo Era”. Topics will include how confidentiality clauses in sexual harassment settlements have and should be treated, how the #MeToo movement is affecting how employers, employees, and unions—and their advocates—are responding to harassment claims, how harassment investigations are approached and conducted, the role of confidentiality clauses, and how the government is responding.
