Since the Ninth Circuit’s decision in K.M. v. Tustin Unified School District, 725 F.3d 1088 (9th Cir. 2013) it is no longer sufficient for school districts and other local education agencies to satisfy their obligations to students with disabilities under the Individual with Disabilities Education Improvement Act (“IDEIA”) and Section 504 of the Rehabilitation Act of 1973 (“Section 504”).  Now school districts may be obligated to provide additional or different aids, services, or accommodations under the Americans with Disabilities Act of 1990 (“ADA”) than would be required under the IDEIA and/or Section 504.  In light of this drastic change, school districts need to develop practices and procedures for responding to student requests for educational services under the ADA. This presentation will review the ADA and its implementing regulations with which school districts must comply and provide practical advice for what to do when faced with a request that may implicate the ADA.
