Overview
Kimberley Worley has nearly 30 years of experience representing employers in matters ranging from individual discrimination, harassment, wrongful termination and retaliation litigation to wage and hour compliance, class actions, PAGA suits and also provides general employment advice.
Ms. Worley is a successful litigator who has guided numerous individual lawsuits, class actions, and PAGA cases through all stages of litigation from inception to successful conclusion, whether through law and motion, mediation, arbitration, jury trial, bench trial, or appeal. Ms. Worley first chairs jury and bench trials in state and federal courts as well as in arbitration hearings.
She focuses on the unique challenges that face employers in the health services industry ranging from whistleblower litigation following employee complaints of alleged patient safety violations to employees terminated for violating HIPAA. In doing so, she represents facilities of a large national health care system, facilities of a health care system located in California and has in the past represented a public employer providing health care services.
Representative Matters
Regularly obtains summary adjudication of punitive damages claims and individual causes of action in a lawsuit, paving the way for favorable settlements.
In 2021, obtained summary judgment in a discrimination and retaliation lawsuit for a facility of a large national health care system.
In 2021, obtained a voluntary dismissal with no payment after deposing the plaintiff.
In 2020, won defense jury verdict in a discrimination and whistleblower litigation for a public health care employer.
