New FEHA Regulations Require Updated Workplace Poster as of April 1

The typical workplace bulletin board is densely packed with legally required posters and employee notifications. As laws change, the posters must be updated to reflect the changes. For example, the minimum wage in California increased to $10 an hour on January 1, 2016; the required poster specifying the minimum wage should reflect that most recent increase.

The Fair Employment and Housing Council’s amendments to regulations under the Fair Employment and Housing Act (FEHA) take effect April 1, 2016, and they require another updated poster. An updated version of so-called Notice A, which describes employee rights and obligations when using Pregnancy Disability Leave, is already available on the DFEH website.  The updated Notice A reflects the amendments to the PDL regulations.

Employers must also post Notice B, which describes the interaction between Pregnancy Disability Leave and leave under the California Family Rights Act. Notice B was last amended in mid-2015. All California employers must also post the Department of Fair Employment and Housing’s poster “California Law Prohibits Workplace Discrimination and Harassment” (DFEH-162), which can also be found on the DFEH website.

When posting the updated PDL material, employers should verify that all the notices required by law are posted and current.
